These terms govern public use of the metabus.ca website and the related lead-capture, informational, and scheduling surfaces (the "Site") operated by Metabus Automation Solutions Inc. ("Metabus", "we", "us"). They are NOT the commercial agreement under which client brands use the Metabus platform to run their own campaigns; that relationship is governed by a separate written Master Services Agreement and Data Processing Addendum executed between Metabus and the client brand. Client-brand websites and the marketing surfaces they operate on the Metabus platform have their own terms.
By accessing or using the Site you agree to be bound by these terms. If you do not agree, do not use the Site.
The Site is intended for businesses and individuals 18 years of age or older with the capacity to enter into a contract. Use of the Site by anyone under 16 is prohibited.
You may use the Site to read our content, submit inquiries through our forms, and schedule consultative calls. You agree not to:
You represent that any information you submit through forms on metabus.ca is accurate and that you have the right to share it. Our handling of personal information is described in our Privacy Policy.
All content on the Site (text, graphics, logos, code, and downloadable materials) is owned by Metabus or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may view and share content for personal and internal business use. You may not redistribute or repurpose it without our written permission.
The Site links to and integrates with third-party services (booking via Cal.com, analytics via Google and Meta, email via Mailgun, dialer infrastructure operated by BuildGravity Inc. as a sub-processor under a written Data Processing Agreement). We are not responsible for the content, terms, or practices of those third parties. Their terms and privacy policies govern your interaction with them. When you interact with Metabus through Meta's surfaces (Facebook, Instagram, Threads) or through the MAS Inc. Marketing App on Meta, Meta's own Platform Terms, Community Standards, Commercial Terms, and Privacy Policy also govern that interaction in addition to these terms.
Metabus operates marketing-technology services on behalf of client brands. If you encountered Metabus through a client-brand advertising campaign (for example, a lead form for Cebucan, BuildGravity, Confluence AI, or another client tenant), the terms and privacy policy of the client brand govern that interaction. These terms do not extend to client-brand surfaces or the data captured on them.
The Site is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Metabus, its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site, even if we have been advised of the possibility of such damages. Our aggregate liability for direct damages arising out of your use of the Site will not exceed the greater of CAD $100 or the total fees you have paid Metabus in the twelve months preceding the event giving rise to the claim. This cap does not apply to liability for fraud, gross negligence, wilful misconduct, our indemnification obligations, statutory damages under PIPEDA or applicable consumer protection legislation, or any other liability that cannot be limited or excluded under applicable law (including statutory rights you may have under the Alberta Consumer Protection Act).
You agree to indemnify and hold harmless Metabus from any claim or demand arising from your breach of these terms or your misuse of the Site.
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we determine in our sole discretion violates these terms or is harmful to other users, us, or third parties.
These terms are governed by the laws of Alberta, Canada without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of the Site is subject to the exclusive jurisdiction of the courts of Alberta, Canada.
We may update these terms from time to time. Material changes will be posted here with a new "last updated" date. Continued use of the Site after a change constitutes acceptance.
